Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Swipe Phot Cleaner application ("App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using Swipe Phot Cleaner, you confirm that you are at least 13 years old and that you agree to these Terms.

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on an iOS device that you own or control, solely for personal, non-commercial use and in accordance with these Terms.

4. In-App Purchases and Subscriptions

The App may offer optional premium features through in-app purchases or subscriptions. Purchases are processed by Apple Inc. as the merchant of record through the App Store. Apple is responsible for payment processing.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings under Settings > Apple ID > Subscriptions.

Refund requests must be directed to Apple. We do not process App Store refunds directly, and Apple's refund policy applies to purchases made through the App Store.

5. Important Warning - Deletion Is Permanent

Swipe Phot Cleaner is designed to help identify photos, videos, duplicates, and other media that may be removed to free space. Deleted files cannot be recovered by the App. Once you confirm deletion, files may be permanently removed from your device.

You are solely responsible for reviewing and confirming which items to delete. We strongly recommend creating a full device backup through iCloud, Finder, or another backup method before using deletion features. We are not liable for data loss resulting from your use of the App's cleanup or deletion features.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free. Use the App at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

8. Intellectual Property

All content, design, code, trademarks, and other intellectual property in the App are owned by or licensed to us. You may not use, reproduce, or distribute any part of the App without prior written permission.

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if required by law. Upon termination, the license granted under Section 2 ends immediately.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Updates and Changes

We may modify or discontinue the App at any time. We may also update these Terms periodically. We will indicate changes by updating the "Last updated" date. Continued use of the App after changes means you accept the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Moldova, without regard to conflict of law principles. Disputes arising under these Terms shall be subject to the jurisdiction of the competent courts of the Republic of Moldova.

13. Apple App Store Terms

These Terms are entered into between you and us only, not with Apple Inc. Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing claims by you or any third party relating to the App, including product liability claims, regulatory claims, or claims arising under consumer protection or similar laws.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
